Mediation and Amicable Resolutions

Resolve Family Law Issues Outside of the Courtroom

While our firm handles all types of divorces and family law matters, the reality is that disputes over issues in these cases arise easily and often cannot be resolved efficiently during such an emotional time without effective, honest, straightforward legal advice. Ultimately many of these disputes can end up in the courtroom where judges will make final decisions about issues that are very personal and important to you, like who has custody, how much child support is paid, whether or not alimony is provided and how your property is divided. It is clear to us that avoiding courtroom decisions is typically in the best interest of everyone.

At the Law Offices of Gale H. Moore, P.A., in Largo, Florida, we have the experience necessary to help clients avoid costly disputes while achieving fair and equitable outcomes. Attorney Gale Moore has more than a decade of family law experience in Pinellas County. Often cases are settled through direct negotiation or mediation. Ms. Moore has also been certified as a family law mediator by the Florida Supreme Court. We can provide the answers you need to help you achieve amicable resolutions in your divorce.

What is Mediation and Collaborative Law in Florida?

Divorce mediation and collaborative law are two alternative methods of dispute resolution that can be used to explore solutions or to create effective settlement agreements for time sharing, alimony, support matters, property division and other issues.

In mediation, a neutral third party acts a facilitator to help the two sides brainstorm ideas and resolve disputes where possible. Sometimes the mediator will offer suggestions or suggest to the parties to explore how certain points of the law may apply to their facts. The mediator will also work to keep the discussions peaceful and results-oriented.

At our firm, lawyer Gale Moore can prepare you for mediation and review any tentative agreements that arise out of mediation.

If we represent you, we will take a comprehensive approach to the mediation process to protect you while working towards a settlement for your entire family.

If we serve as your mediator, we will work in a neutral and unbiased way to help you and your spouse negotiate a resolution in a way that is most likely to find practical solutions and open the door to continued healthy productive communication. In this process both parties sit down and try to resolve their case, with or without their own attorneys. Generally, we find it most helpful to keep the parties in separate rooms during this process so that the emotional aspects of the situation are reduced and parties feel free to openly discuss all their options while Ms. Moore travels between the two parties forwarding ideas and suggestions. If a resolution of some or all issues is reached, Ms. Moore can draft a written proposal to document the agreement reached.

She can also represent a party through the collaborative law process and both parties negotiate an agreement with the assistance of attorneys.

When people make decisions and work out settlements outside of the court process, those solutions are typically better, because the parties are more willing to live up to terms they have had a say in developing. It is usually less confrontational and less expensive than trial and parties are usually more willing to adhere to agreements after the process is finished.
